The conductor aboard a California commuter train that collided last week with a freight train filed a lawsuit Wednesday claiming the accident was preventable, reported The Associated Press. Patrick J. Phillips, 48, seeks unspecified compensatory and punitive damages. The lawsuit names Burlington Northern Santa Fe Railway Co., the National Railroad Passenger Corp. (Amtrak) and the Southern California Regional Rail Authority, which runs Metrolink. Investigators believe the April 23 head-on collision in Placentia, Calif., which killed two and injured hundreds, was caused when the crew of a 67-car Burlington Northern Santa Fe freight train ran past two warning signals. Phillips' attorney said his client suffered a head gash and bleeding on the brain, reported the AP.
